Article 1 — Definitions
- Lessor: GoedkoopSteigerhuren B.V., registered in the Netherlands, CoC 92096549, trading as GoedkoopSteigerhuren.nl.
- Lessee: The natural or legal person who enters into a hire agreement with the Lessor.
- Equipment: The scaffolding material and all related components and accessories hired by the Lessor.
- Hire period: The period for which hire is due, starting on the day of delivery/erection and ending on the day of dismantling/collection.
Article 2 — Applicability
These terms apply to all quotations, orders and hire agreements of the Lessor. Deviations are only valid if agreed in writing. The applicability of the Lessee's own terms is expressly rejected.
Article 3 — Quotations and formation of agreement
All quotations are non-binding and valid for 14 days. An agreement is formed upon written confirmation by the Lessor or actual commencement of performance. All-in prices include transport, erection, hire period and dismantling unless stated otherwise.
Article 4 — Delivery and erection
Delivery dates are indicative. The Lessee must ensure the site is accessible. Erection and dismantling are performed exclusively by certified personnel of the Lessor. The Lessee must not erect or dismantle the scaffold themselves. Use before the release certificate is issued is prohibited.
Article 5 — Use of equipment
The Lessee must use the hired equipment in accordance with its intended purpose and safety regulations including NEN-EN 12811. Sub-letting, selling or transferring the equipment is prohibited. Modifications require prior written consent. Maximum load per platform must not be exceeded.
Article 6 — Hire price and payment
The minimum hire period is seven (7) calendar days. Invoicing occurs after delivery. Payment is due within 14 days of invoice date. Late payment incurs statutory commercial interest and reasonable collection costs.
Article 7 — Cancellation
Cancellation more than 48 hours before planned delivery: no charge. Within 48 hours: 25% of agreed price. On the day of delivery or later: 50% of agreed price.
Article 8 — Damage and liability
The Lessee is liable for damage to hired equipment during the hire period, excluding normal wear. The Lessor's liability is limited to amounts covered by its insurer. The Lessor is never liable for consequential or indirect loss.
Article 9 — Insurance
Equipment is covered by the Lessor's insurance during transport and erection/dismantling. The Lessor recommends the Lessee obtain third-party liability insurance for the hire period. Theft during the hire period is at the Lessee's risk unless demonstrably otherwise.
Article 10 — Permits
Required municipal permits for scaffold placement are the Lessee's responsibility unless expressly agreed otherwise. The Lessor can assist with permit applications; permit fees are at the Lessee's expense.
Article 11 — Safety inspections
The Lessor carries out weekly safety inspections during the hire period. The Lessee must provide access. If defects are found, the scaffold must not be used until repairs are completed and a new release certificate issued.
Article 12 — Dismantling and return
The Lessee must notify the Lessor of the desired dismantling date at least 24 hours in advance. Dismantling is performed by certified personnel. Upon return, equipment is inspected; any damage is recorded and the Lessee signs a return slip.
Article 13 — Force majeure
The Lessor is not liable for non-performance caused by force majeure including extreme weather, strikes, traffic disruption or government measures.
Article 14 — Governing law and disputes
Dutch law applies to all agreements. Disputes are submitted to the competent court in the district where the Lessor is established.
